Important: By creating an account or using AdvisorApex, you agree to these Terms. The platform is available exclusively to licensed Canadian insurance and financial advisors. You are responsible for all regulatory compliance within your practice.
1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a binding agreement between you (“Advisor,” “you,” or “your”) and AdvisorApex Inc. (“AdvisorApex,” “we,” “us”). By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you are using the Services on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.
2. Eligibility
To use AdvisorApex you must:
- Be at least 18 years of age
- Hold a valid provincial insurance, investment, or financial advisory licence issued by a Canadian regulatory authority
- Be located in or operating in Canada
- Not be subject to any regulatory prohibition that would prevent you from conducting your advisory practice
We reserve the right to verify licensing credentials and suspend or terminate accounts that do not meet eligibility requirements.
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@advisorapex.ca if you believe your account has been compromised.
One account is permitted per advisor. Team plans allow multiple licensed advisor seats under one organisation account — each seat holder must independently meet eligibility requirements.
4. Free Trial & Subscriptions
14-Day Free Trial
New accounts receive a 14-day free trial with full access to the selected plan. A valid payment method (credit card or debit card) is required to start the trial. You will not be charged until your trial ends on day 15. If you cancel before the end of day 14, your payment method will not be charged and your account will be deactivated at the end of the trial period.
If you do not cancel before day 15, your selected plan will activate and your payment method will be charged the applicable monthly fee.
Subscriptions
- Subscriptions are billed monthly in advance in Canadian Dollars (CAD).
- Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
- Prices are subject to change with 30 days’ notice. Price changes do not apply mid-billing cycle.
- No refunds are issued for partial months except where required by applicable Canadian consumer protection law.
Cancellation
You may cancel at any time from your account Settings page. On cancellation, access continues until the end of the current billing period. Data is held for 30 days post-cancellation, after which it is permanently deleted.
5. Acceptable Use
You agree NOT to use AdvisorApex to:
- Send commercial electronic messages without valid CASL consent
- Collect, store, or process data relating to individuals outside your licensed provinces without appropriate authority
- Misrepresent your licensing credentials, qualifications, or regulatory status to leads or clients
- Reverse-engineer, scrape, or attempt to extract the platform’s source code or underlying AI models
- Use the platform for any unlawful purpose or in violation of your regulatory obligations
- Upload malicious code, viruses, or any content intended to disrupt the Services
- Share account credentials with unlicensed individuals
6. AI-Generated Content Policy
AdvisorApex uses artificial intelligence to draft communications, analyse lead data, and suggest next actions. All AI-generated content is clearly marked as a draft and requires your explicit approval before any client-facing communication is sent or any action is executed.
You are solely responsible for reviewing, approving, and taking ownership of any communication sent under your name. AdvisorApex does not guarantee the accuracy, compliance, or suitability of AI-generated drafts. Always review drafts for factual accuracy, regulatory compliance, and appropriateness before approval.
No AI agent will autonomously send a message to a client or prospect without your explicit approval. This is a core platform constraint that cannot be overridden.
7. Your Data & Lead Data
You own all data you input into AdvisorApex, including lead records, notes, and communications. You grant AdvisorApex a limited licence to process this data solely to provide the Services. We do not use your data to train AI models or for any purpose beyond operating the platform.
You represent and warrant that you have the right to enter all personal information into the platform and that doing so complies with CASL, PIPEDA, and any other applicable privacy laws.
8. Intellectual Property
The AdvisorApex platform, APEX Framework™ methodology, branding, software, and documentation are proprietary to AdvisorApex Inc. and are protected by copyright, trademark, and other Canadian intellectual property laws. Nothing in these Terms grants you any ownership interest in our intellectual property.
You retain ownership of the content and data you create within the platform.
9. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that any defects will be corrected.
AdvisorApex does not provide legal, regulatory, financial planning, or investment advice. The platform is a software tool to support your practice — it does not replace professional regulatory guidance or your obligations as a licensed advisor.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, ADVISORAPEX INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICES.
Our total aggregate liability to you for any claims arising out of these Terms shall not exceed the amounts you paid to AdvisorApex in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account immediately if you breach these Terms, violate applicable laws or regulations, or engage in conduct that we reasonably believe poses a risk to other users, third parties, or the platform. You may terminate your account at any time via your Settings page.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Canada and applicable provincial law, without regard to conflict-of-law provisions. Any disputes shall be resolved in Canadian courts. Nothing in these Terms limits your rights as a Canadian consumer where applicable consumer protection legislation applies.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated by email at least 14 days in advance. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
